The owner of the online store hiiugourmet.ee (hereinafter the Online Store) is Hiiu Gourmet OÜ (registry code 12334893), located at Hiiu mnt 18, Käina, Hiiumaa, Estonia.

Validity of the Sales Contract, Product and Price Information

These Terms & Conditions apply to the purchase of goods from the Online Store.

The prices of products sold in the Online Store are indicated next to the products. A delivery fee is added to the price.

The delivery fee depends on the buyer’s location and the selected delivery method. The delivery fee is displayed to the buyer during the checkout process.

Information about the products is provided directly next to the products in the Online Store.


Placing an Order

To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The total amount payable will then be displayed on the screen and can be paid via a bank link or another available payment solution.

The sales contract enters into force upon receipt of the payable amount to the Online Store’s bank account.

If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed at the earliest opportunity and the paid amount (including delivery costs) will generally be refunded within 1–2 business days. Depending on the payment method, the refund may take up to 7 business days to reach the buyer.

Delivery

Goods are delivered to the following countries: Estonia, Finland, Latvia, and Lithuania.

The delivery costs are borne by the buyer and the corresponding price information is displayed next to the delivery method.

Domestic shipments within Estonia generally arrive at the destination specified by the buyer within 2–7 business days from the entry into force of the sales contract.
Delivery outside Estonia generally takes 7–14 calendar days.

In exceptional cases, the Online Store has the right to deliver goods within up to 30 calendar days.

If the Online Store has informed the buyer on the website or in the order confirmation about delivery issues and a delivery period exceeding 30 calendar days, the deadline published by the Online Store shall apply.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days, except for food products and other products to which the right of withdrawal does not apply in accordance with § 53 (4) of the Law of Obligations Act (including food products with opened packaging).

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the goods, as permitted for testing goods in a physical store.

If the goods have been used for other purposes or show signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

To return the goods, a withdrawal form must be submitted and sent to hiiugourmet@gmail.com no later than 14 days after receiving the goods.

The costs of returning the goods are borne by the buyer, except where the reason for return is that the returned goods do not correspond to the order (e.g. incorrect or defective goods).

The buyer must return the goods within 14 days after submitting the withdrawal statement or provide proof that the goods have been handed over to the carrier within that period.

Upon receipt of the returned goods, the Online Store will refund the buyer without delay, but no later than 14 days after receiving the withdrawal notice, all payments received from the buyer under the contract.

The Online Store may refuse to issue a refund until it has received the goods back or until the buyer has provided proof that the goods have been returned, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the standard delivery cost.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been marked significantly below the market price due to an error.

Right to Submit a Complaint

The Online Store is liable for any non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and becomes apparent within two years from the delivery of the goods to the buyer.

During the first year from delivery, it is presumed that the defect existed at the time of delivery. The burden of proof to rebut this presumption lies with the Online Store.

In the event of a defect, the buyer must contact the Online Store no later than two months after discovering the defect by sending an email to hiiugourmet@gmail.com or calling +372 5648 0998

The Online Store is not liable for defects that arise after delivery due to the buyer’s actions or omissions or due to normal wear and tear resulting from ordinary use.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund all fees associated with the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store processes personal data in accordance with the applicable Privacy Policy. Marketing communications are sent only with the buyer’s consent, which may be withdrawn at any time.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they must be sent to hiiugourmet@gmail.com or submitted by phone at  +372 5648 0998

If the buyer and the Online Store are unable to resolve the dispute by mutual agreement, the buyer may turn to the Consumer Disputes Committee (https://komisjon.ee). Review of the buyer’s complaint by the committee is free of charge.
